PLEASE READ THESE TERMS CAREFULLY. BY SUBMITTING THIS ASSESSMENT, THE BUSINESS AGREES TO BE BOUND BY THESE TERMS AND CONDITIONS.
These Terms and Conditions (“Terms”) govern the access to and use of the Greenopia Sustainability Assessment and the subsequent display of Business Information and Sustainability Scores (“Service”) by the business submitting the information (“Business” or “You”).
Greenopia provides a sustainability assessment tool for businesses. Based on the data provided, Greenopia calculates a Sustainability Score across three pillars: Good for You, Good for the Planet, and Good for the Community. This Score is used to assign Badges displayed in the Greenopia Consumer Application (the “App”). The Service also allows the Business to showcase its efforts via the App by providing Business Information, including: photos, 'Eco Tags,' a descriptive summary, location, and contact details.
The Business will be included in Greenopia's platform listings of sustainable, local businesses provided the Business achieves a passing score in at least one (1) of the three (3) Sustainability Pillars. Meeting this minimum threshold confirms the eligibility of the business to be listed in the App, subject to all other terms herein. Greenopia reserves the right to determine the passing criteria for each pillar. Businesses may re-take the assessment periodically in order to update their scores if there have been changes to their business practices that they wish to share. Greenopia reserves the right to determine how frequently businesses may update their assessment.
The Business acknowledges that all Business Information (including photos, Eco Tags, descriptions, location, contact details, Sustainability Score, and Badges) will be publicly displayed and visible to users of the Greenopia App. Furthermore, the Business expressly agrees and understands that Greenopia users will have the ability to engage with the Business’s profile, including the ability to comment on, 'like,' or flag the Business. This user feedback and flagging may be based on the accuracy of the profile contents or the user's direct experiences visiting the Business and its premises. The Business assumes all risk and responsibility associated with its public listing and subsequent user-generated content.
The Business acknowledges that it has sole and complete responsibility for all information, data, photos, 'Eco Tags,' descriptions, and representations made on the Greenopia platform or within the assessment.
By submitting data for the assessment, the Business represents and warrants that:
The Business agrees to promptly notify Greenopia of any material changes to its practices or data that would affect its Score, Badges, or Platform Eligibility. Greenopia reserves the right to request verification or re-submission of the assessment at any time.
The Business hereby grants Greenopia a worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, display, and distribute the following data solely for the purpose of operating the Greenopia Service:
The Business acknowledges and agrees that the Sustainability Score and Badges are the exclusive property of Greenopia and are generated by Greenopia’s proprietary methodology. Greenopia reserves the right to update, modify, or change the underlying scoring algorithm and criteria from time to time to ensure accuracy and relevance, without requiring the prior consent of the Business. Such changes may result in an updated Score and Badges for the Business.
The Business agrees that Greenopia may use the aggregated and anonymized assessment data for market analysis, reports, research, and internal business improvement without requiring further consent or providing any compensation to the Business.
GREENOPIA IS NOT A RATING, CERTIFICATION, OR AUDITING AGENCY. Greenopia acts as a platform for businesses to voluntarily showcase their self-reported sustainability efforts. The calculation of a score and the display of badges are based solely on the information provided by the Business.
Greenopia is a marketplace whose purpose is to uplift and promote local businesses that meet their criteria, making it easier for consumers to find local, sustainable businesses. The Sustainability Score, Badges, and all associated recommendations are provided for informational and consumer-guidance purposes only. They are not, and shall not be construed as:
Greenopia shall not be liable for any claims, damages, or losses arising from the accuracy or completeness of the data provided by the Business (including photos), nor for any business decision made by a consumer based on the information displayed in the App, including any user-generated comments or ratings.
Greenopia reserves the right, at its sole discretion and without prior notice, to:
The Business agrees to indemnify, defend, and hold harmless Greenopia and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, USA.
Entire Agreement: These Terms constitute the entire agreement between the Business and Greenopia concerning the Service.
Modifications: Greenopia reserves the right to modify these Terms at any time. The Business will be notified of material changes, and continued use of the Service constitutes acceptance of the new Terms.
